These Terms of Use ("Terms") govern access to https://zholy.ai and the ZHOLY platform operated by Polare Group Sàrl (CHE-221.062.769), Geneva, Switzerland. By accessing or using ZHOLY, you agree to these Terms. If you use ZHOLY on behalf of an organisation, you represent that you have authority to bind that organisation.
1. The service
ZHOLY provides an embeddable conversational interface: voice and text interaction, page navigation, lead capture, integrations, and optional vision features. Features vary by plan (LOCAL, CLOUD, SOVEREIGN).
2. Accounts
- You must provide accurate registration information and keep credentials secure.
- You are responsible for all activity under your account.
- We may suspend accounts for breach, abuse, non-payment, or legal requirement.
3. Acceptable use
You must not:
- Use ZHOLY for unlawful, deceptive, or harmful purposes
- Attempt to bypass security, scrape credentials, or overload infrastructure
- Process special-category data (health, biometric ID, etc.) without appropriate legal basis and configuration
- Misrepresent AI-generated responses as human where law requires disclosure
- Reverse-engineer the service except where mandatory law allows
4. Intellectual property
Polare Group Sàrl retains all rights in ZHOLY software, branding, and documentation. You receive a limited, non-exclusive licence to use the service per your plan. You retain ownership of your content and visitor data; you grant us a licence to process it solely to provide the service.
5. AI outputs
ZHOLY uses large language and speech models. Outputs may be inaccurate or incomplete. You are responsible for reviewing AI responses before relying on them for decisions with legal, medical, financial, or safety consequences. We do not guarantee correctness of generated content.
6. Paid plans
Paid subscriptions are governed additionally by our Subscription Terms. Free and self-hosted tiers may have usage limits described on the pricing page.
7. Privacy
Personal data is processed as described in our Privacy Policy and applicable Data Processing Agreement for business customers.
8. Availability & support
We aim for high availability but do not guarantee uninterrupted service. Maintenance windows may occur. Support levels depend on your plan. LOCAL (self-hosted) support covers software updates; you operate infrastructure.
9. Limitation of liability
To the maximum extent permitted under Swiss law, Polare Group Sàrl is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our aggregate liability for any claim arising from these Terms is limited to the fees you paid in the twelve (12) months preceding the claim, or CHF 100 if you use a free tier. Mandatory statutory liability (e.g. for intent or gross negligence) remains unaffected.
10. Termination
You may close your account at any time. We may terminate or suspend access for material breach after notice where reasonable. Upon termination, your right to use the service ceases; export provisions in the dashboard apply where available.
11. Governing law & jurisdiction
These Terms are governed by substantive Swiss law, excluding conflict-of-law rules and the CISG. Exclusive place of jurisdiction for commercial disputes is the courts of Geneva, Switzerland, subject to mandatory consumer protections in your country of residence if you are a consumer.
